There have been a few. I think Code Hero was the largest one where no game was developed and the backers were just screwed. Kickstarter's terms of service say they are obligated to deliver on their promises, but only a court of law can really enforce that. Kickstarter carries more risk than a traditional pre-order, but usually more benefit as well.

I guess the ultimate story of you never know is Double Fine Adventure/Broken Age. They were an established company that had released several games over the years. People felt like they could trust this company to deliver on their promises. They asked for $400,000 to make an adventure game. They received $3.3 million (minus Amazon/KS fees and physical reward fulfillment). Still, they got 8 times the amount they asked for. There were rumors they blew through the money and they were in trouble.

Then they released other games that looked like cash grab games. They had Amnesia Fortnight, which brought in more revenue. They did a Steam sale, which brought in more revenue. They did a Humble Bundle sale, which brought in more revenue.

Then they publicly announced even with all this additional revenue, they couldn't afford to finish the first half of the game. So they sold the first half of the game on Steam Early Access to bring in more revenue to finish that first half. It was released, but I think there is reason to suspect they will have trouble finishing the second half without additional revenue.

And your example of why myself and others have cold feet until there are investor protections in place. As yu elluded to yu never really know how things will turn out and more often than not they promsie the moon and deliver a cheese playter
